Pollinator Oasis Terms of Service

Welcome to Pollinator Oasis. These Terms of Service (“Terms”) govern your use of the Pollinator Oasis mobile application, website, and related services.

Please read these Terms before creating an account or using Pollinator Oasis.

1. About Pollinator Oasis

Pollinator Oasis LLC (“Pollinator Oasis,” “we,” “us,” or “our”) provides educational tools, garden records, seasonal guidance, weather-aware recommendations, reminders, and other resources intended to help people care for mason bees and other pollinators.

Pollinator Oasis LLC and Crown Bees are affiliated businesses based in Washington. Crown Bees provides pollinator products, educational resources, Harvest Service, and other services that may be linked to or used with Pollinator Oasis.

Although the two businesses may work together to provide a connected experience, Crown Bees products, purchases, fulfillment, refunds, and services may be governed by separate terms and policies.

2. Accepting these Terms

By creating an account, purchasing Pollinator Oasis Plus, or using Pollinator Oasis, you agree to these Terms and our Privacy Policy.

If you do not agree, please do not use Pollinator Oasis.

3. Eligibility and accounts

You must be at least 18 years old to create a Pollinator Oasis account.

Bee Buddies participation involving children must be created and controlled by an adult account holder. Children do not hold independent Pollinator Oasis or Bee Buddies accounts.

You agree to provide accurate account information and keep your login credentials secure. You are responsible for activity through your account unless applicable law provides otherwise.

Please contact support@pollinatoroasis.com if you believe someone has accessed your account without permission.

4. The Free version

Pollinator Oasis provides a Free version of the app that may be used without purchasing Plus.

The features included in the Free version may evolve as Pollinator Oasis develops. Essential bee-care information is not conditioned on purchasing a Crown Bees product or a Pollinator Oasis Plus subscription.

5. Pollinator Oasis Plus

Pollinator Oasis Plus is an automatically renewing annual subscription that provides access to additional app features.

The United States price is $20.00 per year. The app store will display the final price, currency, and applicable taxes before you purchase. Prices may vary by country or region.

There is no free trial or introductory offer. The Free version of Pollinator Oasis remains available separately.

Your subscription begins when the applicable app store confirms your purchase. Plus automatically renews each year until you cancel it. The Apple App Store or Google Play will charge your store account at the beginning of each billing period according to its payment terms.

If the price changes, the app store will provide any notice or request any consent required by its rules or applicable law.

6. Managing and canceling Plus

Apple and Google manage subscriptions purchased through their respective stores.

You can cancel Plus through the same store that processed your purchase:

Cancel before the renewal date displayed by the app store to avoid the next annual charge.

Canceling normally stops future renewal while allowing you to use Plus through the end of the paid billing period, subject to the app store’s rules and applicable law.

Uninstalling Pollinator Oasis does not cancel your subscription.

7. Payments and refunds

Apple or Google processes your Plus payment. Their billing terms, payment methods, taxes, refund rules, and purchase protections apply to the transaction.

Refund eligibility is determined under the applicable store’s policies and applicable law. A refund is not guaranteed merely because you cancel a subscription or stop using the app.

To request a refund:

For a technical problem, missing Plus access, or a purchase that is not being recognized properly, contact support@pollinatoroasis.com. We can help investigate access problems, but we cannot make billing decisions controlled exclusively by Apple or Google.

8. Account deletion and Plus

You may permanently delete your Pollinator Oasis account through:

Profile → Privacy & Data → Delete your account

You may also request deletion without reinstalling the app at:

Deleting your Pollinator Oasis account does not cancel an Apple App Store or Google Play subscription. You should cancel your subscription through the applicable store before deleting your account.

If you delete the account associated with Plus, you may lose access to Plus features even if time remains in your paid billing period. Account deletion does not automatically create a refund.

Deleting a Pollinator Oasis account also does not automatically delete separate Crown Bees or Shopify transaction, payment, tax, shipping, or fulfillment records.

9. Pollinator guidance is informational

Pollinator Oasis uses available information to help you make seasonal decisions. This may include information about your garden, plants, bloom conditions, local weather, growing degree days, mason bee cocoons, nesting materials, inventory, observations, and other information you provide.

Recommendations, calculations, estimates, reminders, alerts, and educational content are provided for general informational and decision-support purposes. They are not guarantees of biological, agricultural, gardening, financial, or commercial results.

Pollinator Oasis does not provide medical, veterinary, pesticide, legal, or other licensed professional advice.

10. Weather, bloom, and release estimates

Growing degree day calculations, bloom estimates, pollination estimates, and release guidance are based on available weather data, biological models, user-provided information, and other factors.

Weather information may be delayed, incomplete, or inaccurate. Actual conditions, bee development, emergence, nesting, plant health, and bloom timing may vary.

Notifications are a convenience and should not be your only source of information. You remain responsible for observing local conditions and deciding what action is appropriate for your garden and bees.

11. Bee handling and outdoor safety

Working with bees, insects, plants, tools, nesting materials, and outdoor environments involves risks.

Although mason bees and many other solitary bees are generally non-aggressive, insects can sting or cause allergic reactions. Gardening and nest-harvesting activities may also involve pollen, dust, mold, mites, debris, tools, uneven surfaces, temperature exposure, and other hazards.

Use reasonable precautions and seek qualified medical assistance for allergy, sting, or health concerns. Do not rely on Pollinator Oasis for emergency or medical guidance.

12. No guarantee of results

Pollinator Oasis does not guarantee:

  • Bee emergence, survival, nesting, reproduction, or health
  • Pollination success or crop yield
  • Bloom timing or weather conditions
  • Harvest or cocoon quantities
  • Product or program eligibility
  • The accuracy of user-entered information
  • Continuous or uninterrupted availability of the app

Results depend on environmental conditions, user decisions, bee and plant health, third-party information, and factors outside our control.

13. Your responsibilities

You are responsible for using reasonable judgment when:

  • Caring for bees and handling cocoons
  • Selecting, cleaning, or storing nesting materials
  • Responding to weather and seasonal conditions
  • Managing plants, pesticides, and your garden
  • Harvesting nests
  • Acting on information provided by Pollinator Oasis

You are also responsible for complying with applicable laws concerning bees, wildlife, plants, pesticides, agriculture, property use, and the import, transport, release, or sale of pollinators.

14. Your garden information and content

You retain ownership of the garden records, observations, photographs, notes, and other content you submit to Pollinator Oasis.

You give Pollinator Oasis a limited permission to store, process, display, back up, and use that content as reasonably needed to provide, secure, maintain, and improve the service as described in our Privacy Policy.

You represent that you have the right to provide the content you submit and that it does not violate another person’s rights or applicable law.

15. Notifications and SMS

Pollinator Oasis may offer push, email, or text notifications concerning account activity, weather, bloom, bee release, nesting, harvest, storage, supplies, garden care, or other seasonal activities.

Delivery is not guaranteed and may depend on your device, wireless carrier, internet connection, operating system, permissions, and third-party providers.

The Pollinator Oasis text messaging program provides voluntary account and service notifications you select, including urgent bee-care timing, garden or weather alerts, seasonal reminders, and order or Harvest Service status. Message frequency varies. Message and data rates may apply. SMS consent is not required to purchase.

Reply STOP to cancel text messages or HELP for assistance. You may also contact support@pollinatoroasis.com. Wireless carriers are not responsible for delayed or undelivered messages.

Our handling of phone numbers and SMS consent information is described in our Privacy Policy.

16. Crown Bees products and Shopify purchases

Pollinator Oasis may recommend or link to Crown Bees products and services when they may be useful for a seasonal activity.

Product availability, pricing, payment, shipping, returns, warranties, refunds, and fulfillment are governed by the policies that apply to Crown Bees and its Shopify storefront.

A Crown Bees or Shopify purchase is separate from a Pollinator Oasis Plus subscription unless the offer expressly states otherwise.

17. Harvest Service, Bee Buyback, and Bee Buddies

Harvest Service may have separate instructions, fees, eligibility requirements, submission deadlines, shipping responsibilities, risks, and service-specific terms. Access to a Harvest Service feature in Pollinator Oasis does not replace those separate requirements.

Participation in Bee Buyback may depend on quality, quantity, timing, inspection, pricing, geographic availability, and separate program terms. Acceptance or purchase of bees is not guaranteed.

Bee Buddies and other community or philanthropic programs may have separate program descriptions, participation requirements, and donation terms. An adult must control any participation involving a child.

If separate program terms conflict with these Terms on a program-specific matter, the applicable program terms control for that matter.

18. Acceptable use

You agree not to:

  • Use Pollinator Oasis for unlawful, deceptive, or fraudulent purposes
  • Attempt to access another person’s account or restricted systems
  • Interfere with the operation or security of the service
  • Upload malicious code or deliberately harmful information
  • Misrepresent your identity or eligibility
  • Scrape or automatically extract service data without permission
  • Copy, resell, sublicense, or commercially exploit the service
  • Reverse engineer the app except where applicable law expressly permits it
  • Infringe intellectual-property, privacy, or other rights
  • Use Pollinator Oasis in a way that harms people, pollinators, property, or the service

19. Intellectual property and app license

Pollinator Oasis and its software, branding, designs, text, graphics, databases, educational materials, calculations, and other content are owned by or licensed to Pollinator Oasis LLC and are protected by applicable law.

Crown Bees names, marks, products, photographs, videos, and written materials remain the property of Crown Bees or its licensors.

We give you a limited, personal, nonexclusive, nontransferable, revocable license to use Pollinator Oasis for lawful, noncommercial purposes in accordance with these Terms and the rules of the app store from which you obtained it.

No other rights are granted.

20. Third-party services and app stores

Pollinator Oasis relies on third parties for services such as authentication, weather information, cloud hosting, communications, app distribution, payment processing, subscriptions, and commerce.

We are not responsible for third-party services or information outside our reasonable control. Your use of those services may also be governed by their own terms and privacy policies.

If you download Pollinator Oasis through Apple or Google, the applicable app-store terms also apply. Apple and Google are not responsible for providing Pollinator Oasis support.

To the extent required by Apple’s rules, Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the Apple-licensed app.

21. Changes to the service

Pollinator Oasis is growing. We may add, change, suspend, or discontinue features, integrations, data sources, notifications, or programs.

We will provide notice when required by law. Nothing in this section limits rights you may have concerning a paid subscription or digital service under applicable law.

22. Suspension and termination

We may suspend or terminate access when reasonably necessary to:

  • Protect users, pollinators, or our systems
  • Investigate fraud, misuse, or security concerns
  • Enforce these Terms
  • Comply with law
  • Address prolonged account inactivity
  • Discontinue Pollinator Oasis

You may stop using Pollinator Oasis at any time. You may also permanently delete your account as explained above.

Terms that logically need to continue after termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute provisions—will remain in effect.

23. Disclaimers

To the maximum extent permitted by law, Pollinator Oasis and its content, calculations, alerts, and services are provided “as is” and “as available.”

We do not promise that the service will always be available, error-free, or suitable for every garden, climate, plant, bee species, or purpose.

To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

These disclaimers do not limit warranties or consumer rights that cannot legally be excluded.

24. Limitation of liability

To the maximum extent permitted by law, Pollinator Oasis LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of Pollinator Oasis.

This includes loss of bees, cocoons, crops, pollination, garden productivity, data, profits, opportunity, or goodwill.

To the maximum extent permitted by law, our total liability for claims relating to Pollinator Oasis will not exceed the greater of:

  • The amount you paid Pollinator Oasis for the service during the 12 months before the claim; or
  • $100.00.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

25. Indemnification

To the extent permitted by law, you agree to reimburse Pollinator Oasis LLC for reasonable losses, liabilities, and expenses resulting from your intentional unlawful misuse of the service, violation of these Terms, or infringement of another person’s rights.

This section does not require you to indemnify Pollinator Oasis for our own negligence, unlawful conduct, or violation of these Terms.

26. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.

Any court proceeding relating to these Terms or Pollinator Oasis must be brought in a state or federal court with jurisdiction in King County, Washington, unless applicable consumer law allows you to bring the matter elsewhere.

Nothing in these Terms removes rights or remedies you have under applicable consumer-protection law.

These Terms do not require arbitration and do not contain a class-action waiver.

27. Changes to these Terms

We may update these Terms as Pollinator Oasis, our business, or legal requirements change.

We will post the revised Terms and update the effective date above. If a change materially affects your rights, we will provide additional notice or request consent when required by law.

Your continued use of Pollinator Oasis after updated Terms become effective means you accept the updated Terms, except where applicable law requires another form of consent.

28. General terms

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms, the Privacy Policy, any applicable subscription disclosures, and any service-specific terms form the agreement between you and Pollinator Oasis concerning the service.
